Ordinance amending the Planning Code to create an exception for certain distilleries, wineries, and breweries to establish on-sale liquor establishments in the Bayview Neighborhood Commercial District, subject to a conditional use authorization; affirming the Planning Department’s determination under the California Environmental Quality Act; making findings of consistency with the General Plan, and the eight priority policies of Planning Code, Section 101.1; and making findings of public necessity, convenience, and welfare pursuant to Planning Code, Section 302.

The Board established the Third Street Alcohol Restricted Use District to address the overconcentration of liquor stores and the lack of essential neighborhood services.

Supervisor Walton introduced the ordinance to amend the Planning Code to create an exception for certain distilleries, wineries, and breweries to establish on-sale liquor establishments in the Bayview Neighborhood Commercial District.

The Board referred the proposed legislation to the Planning Department for review and CEQA determination.

The Planning Department determined that the proposed amendments are not defined as a project under CEQA Guidelines because they do not result in a physical change in the environment.

The Planning Commission conducted a public hearing and adopted a recommendation for approval of the ordinance, affirming its consistency with the General Plan and priority policies.

The Land Use and Transportation Committee recommended the ordinance as a committee report to the Board of Supervisors.

The Board of Supervisors finally passed the ordinance, allowing certain distilleries, wineries, and breweries to establish on-sale liquor establishments in the Bayview Neighborhood Commercial District.
