Ordinance amending the Planning Code to permit parking of up to two operable vehicles, not including boats, trailers, recreational vehicles, mobile homes, or buses, in driveways located in required front setbacks, side yards, or rear yards; affirming the Planning Department’s determination under the California Environmental Quality Act; making findings of consistency with the General Plan, and the eight priority policies of Planning Code, Section 101.1; and making findings of public necessity, convenience, and welfare pursuant to Planning Code, Section 302.

Mayor Lurie introduced an ordinance to amend the Planning Code to permit parking of up to two operable vehicles in driveways located in required front setbacks, side yards, or rear yards.

The Board of Supervisors referred the proposed legislation to the Planning Department for review under the California Environmental Quality Act (CEQA).

The Planning Department determined that the proposed ordinance is not defined as a project under CEQA, indicating it would not result in a direct or indirect physical change in the environment.

The Planning Commission held a public hearing and adopted a recommendation for approval of the ordinance with modifications, including specifying that parking may be allowed on driveways that formerly provided access to enclosed parking.

The committee recommended amendments to the ordinance, incorporating the Planning Commission's modifications and clarifying the definition of driveways.

The Board of Supervisors finally passed the ordinance, allowing parking of up to two operable vehicles in specified driveways.
