Ordinance re-adopting the former Planning Code section and Zoning Map designations creating the Mission and 9th Street Special Use District (SUD) at 1270 Mission Street, located at Assessor’s Parcel Block No. 3701, Lot Nos. 20 and 21, in the area generally bounded by Mission Street on the south, Laskie Street on the east, Assessor’s Parcel Block No. 3701, Lot Nos. 22, 23, and 24, on the west, and Assessor’s Parcel Block No. 3701, Lot No. 66, on the north; changing the height limit on Assessor’s Parcel Block No. 3701, Lot Nos. 20 and 21, for projects that comply with the requirements of the SUD, from 120-X to 200-X; affirming the Planning Department’s determination under the California Environmental Quality Act; making findings of consistency with the General Plan, and the eight priority policies of Planning Code, Section 101.1; and making findings of public convenience, necessity, and welfare under Planning Code, Section 302.
How it got here
The legislation to re-adopt the Mission and 9th Street Special Use District originated from the expiration of previous zoning provisions and the need to facilitate a 100% affordable housing project at 1270 Mission Street.
The Board adopted Ordinance Nos. 252-16 and 4-17, creating the Mission and 9th Street Special Use District, allowing for a mixed-use development at 1270 Mission Street.
The provisions of the Mission and 9th Street Special Use District expired by operation of law as no first construction document was obtained by the deadline.
A site permit was issued for the project at 1270 Mission Street, but the project sponsor was unable to obtain a first construction document due to various challenges.
The Planning Department affirmed the adequacy of the Mitigated Negative Declaration for the project, which was necessary for the re-adoption of the Special Use District.
Supervisor Dorsey introduced the ordinance to re-adopt the Mission and 9th Street Special Use District to facilitate a 100% affordable housing project.
The Planning Commission adopted a recommendation for approval of the ordinance, affirming its consistency with the General Plan.
The Board of Supervisors passed the ordinance, re-adopting the Mission and 9th Street Special Use District, allowing for increased height limits and affordable housing requirements.
