This ordinance allows certain projects that convert commercial buildings to residential use to bypass specific parking limits, car share requirements, and loading regulations. It also confirms that the Planning Department's assessment complies with environmental laws and aligns with city planning priorities.
Ordinance amending the Planning Code to exempt Commercial to Residential Adaptive Reuse Projects from certain parking limits, car share obligations, loading requirements, and other development controls; affirming the Planning Department’s determination under the California Environmental Quality Act; making findings of consistency with the General Plan, and the eight priority policies of Planning Code, Section 101.1; and making public necessity, convenience, and welfare findings under Planning Code, Section 302.
How it got here
The legislation originated from the need to amend the Planning Code to facilitate the conversion of commercial properties to residential use by relaxing certain development controls.
The Planning Department reviewed the existing Commercial to Residential Adaptive Reuse Program, which allows for the conversion of commercial spaces to residential units but does not currently exempt parking requirements.
The Planning Commission adopted findings that the proposed amendments are consistent with the City’s General Plan and the eight priority policies of Planning Code Section 101.1.
Supervisor Dorsey introduced the ordinance to amend the Planning Code, based on the Planning Department's recommendations to exempt certain development controls for adaptive reuse projects.
The ordinance was assigned to the Board of Supervisors under the 30-day rule for further consideration.
