Resolution granting revocable permission to 555 Fulton Street Development, LLC to construct and maintain encroachments in the public right-of-way, including but not limited to stamped asphalt on the roadway of Birch Street between Laguna and Octavia Streets, tree wells with metal gutter covers, pavers, and a raised crosswalk, fronting upon 555 Fulton Street, Assessor’s Parcel Block No. 0794, Lot Nos. 059 through 198; adopting environmental findings under the California Environmental Quality Act; and making findings of consistency with the General Plan, and the eight priority policies of Planning Code, Section 101.1.

BKF Engineers submitted a request to the Department of Public Works for a Major Encroachment Permit to install improvements on Birch Street as part of the 555 Fulton Project.

A public hearing was conducted regarding the Major Encroachment Permit, with no public testimony in favor or opposition.

The Planning Commission found that the project is in conformity with the General Plan and approved the Final Mitigated Negative Declaration for the Mixed-Use Project at 555 Fulton Street.

The Transportation Advisory Staff Committee reviewed the design elements of the encroachments and raised no objections.

Public Works recommended approval of the Major Encroachment Permit to the Board of Supervisors.

The resolution granting revocable permission for the encroachments was received from the Department of Public Works.

The resolution is currently pending committee action in the Board of Supervisors.
