How it got here
The legislation originated from the need to address appeals against the Planning Commission's certification of the Final Environmental Impact Report for the PG&E Power Asset Acquisition Project.
The SFPUC filed a project application with the Planning Department to initiate the environmental review process for the PG&E Power Asset Acquisition Project under CEQA.
The Planning Department published a Preliminary Mitigated Negative Declaration for the Project, but later determined that an Environmental Impact Report was necessary due to public comments and appeals.
A Notice of Preparation was issued, and the public scoping process for the Environmental Impact Report concluded on July 28, 2023.
The Draft Environmental Impact Report was published and circulated for public review, including a public hearing held on April 17, 2025.
The Planning Commission certified the Final Environmental Impact Report by Motion No. M-21929, concluding it complied with CEQA and adequately analyzed the Project.
Christian H. Cebrian and Alaura McGuire filed appeals against the certification of the FEIR, which were determined to be timely by the Planning Department's Environmental Review Officer.
The Board of Supervisors held a public hearing to consider the appeals and subsequently directed the Clerk of the Board to prepare findings to reverse the Planning Commissionβs certification of the FEIR.
