The ordinance updates the Local Business Enterprise (LBE) and Non-Discrimination in Contracting rules to increase certification thresholds, adjust penalty amounts, and improve payment processes for subcontractors. It also introduces new programs and reporting requirements to support local businesses and enhance participation in city contracts.

Ordinance amending the Administrative Code to revise the Local Business Enterprise (LBE) and Non-Discrimination in Contracting Ordinance (Chapter 14B) to: 1) increase the LBE certification size thresholds and authorize an automatic increase to the thresholds every five years based on the consumer price index; 2) change the LBE certification size threshold term of calculation from an average of gross annual receipts in the prior three to the prior five years; 3) increase penalties for violations of Chapter 14B from up to 10% to up to 25% of the contract or subcontract amount; 4) require prime contractors to include LBE subcontractors’ approved payment requests in payment applications within 30 days of receipt of an invoice; 5) authorize application of separate LBE subcontract participation requirements for micro, small, and SBA-LBEs; 6) extend the bonding assistance program to certain City-funded construction projects; 7) authorize a pilot Mentor-Protégé expansion program, a pilot micro-LBE set-aside program for certain design-build and construction manager/general contractor projects, and a pilot Neighborhood LBE program; 8) require additional data collection and reporting on the LBE status of all bidders, specifically LBEs certified as both MBE and WBE; and 9) increase the contracting Threshold Amount from $706,000 to $1,000,000 and the Minimum Competitive Amount from $129,000 to $200,000; and make various other changes and clarifications to Chapter 14B.

This ordinance ensures that tenant-occupied units receiving certain housing financial assistance remain under rent control as long as any current tenants stay, unless they agree in writing to change that. It also restores rent levels for units that became exempt from rent control since 2018 to what they would have been if the rent control had always applied.

Ordinance amending the Administrative Code to provide that tenant-occupied units in buildings that will be receiving either low-income housing tax credits or tax-exempt multifamily revenue bonds shall remain subject to the Rent Ordinance, as long as any of the existing tenants continue to reside in the unit, or unless all the tenants in the unit agree otherwise in writing; and for any such units that may have previously become exempt from the Rent Ordinance since 2018, restoring rents to the levels allowed had the Rent Ordinance continuously applied.

This ordinance raises the minimum hourly pay for employees of nonprofit City contractors to $23.00 by January 1, 2026, and for public entity City contractors to $25.50 by January 1, 2027, with annual increases tied to the Consumer Price Index. It also adjusts the exemption rules for youth employees in summer and after-school programs.

Ordinance amending the Administrative Code to increase the minimum hourly compensation rate for employees of nonprofit City contractors incrementally to $23.00 per hour by January 1, 2026, with annual increases every July thereafter based on increases in the Consumer Price Index; to increase the minimum hourly compensation rate for employees of public entity City contractors incrementally to $25.50 per hour by January 1, 2027, with annual increases every July thereafter based on increases in the regional Consumer Price Index for certain workers; and to modify the exemption to minimum compensation requirements for youth employees in summer and after-school programs.

This ordinance removes the City’s annual joint fundraising drive, which previously collected donations for various charities. As a result, the City will no longer organize or participate in this fundraising event.

This ordinance updates the definition of the City's Technology Marketplace to reflect current terminology and modifies the fees that City departments pay for technology goods and services. It aims to streamline procurement processes and ensure consistency in language used.

This ordinance allows the Department of Public Health to approve managed care contracts until December 31, 2028, without needing a review from the Controller for certain contracts based on state-set rates or actual healthcare costs. It amends the Administrative Code to extend this authority from the Board of Supervisors.

This ordinance clarifies the rules for filming news events without a contract and updates the appointment process for the Executive Director of the Film Commission. It also increases fees for film production, allows the Executive Director to approve the use of the Film SF logo, and permits the use of certain funds to manage and promote the Film Rebate Program.

This ordinance allocates $501,908 for the Port Commission and $97,057,341 for the San Francisco Public Utilities Commission for the fiscal year 2023-2024. It ensures funding for various projects and services managed by these agencies.

This ordinance allows San Francisco to opt out of a state law that mandates listing the names of supporters and opponents of local ballot measures on the ballot for elections in Fiscal Year 2023-24 and beyond, pending Board of Supervisors approval. This ordinance allows the San Francisco Public Utilities Commission to issue up to $41 million in bonds to fund various capital projects for the Power Enterprise. It also authorizes the issuance of refunding bonds and confirms previous related actions.

Ordinance authorizing the issuance and sale of tax-exempt or taxable Power Revenue Bonds and other forms of indebtedness (as described below) by the San Francisco Public Utilities Commission (“Commission”) in an aggregate principal amount not to exceed $41,031,367 to finance the costs of various capital projects benefitting the Power Enterprise under the Charter, including amendments to the Charter enacted by the voters on June 5, 2018, commonly referred to as Proposition A; authorizing the issuance of Power Revenue Refunding Bonds; declaring the Official Intent of the Commission to reimburse itself with one or more issues of tax-exempt or taxable bonds or other forms of indebtedness; and ratifying previous actions taken in connection therewith, as defined herein.

This ordinance updates the city's salary ordinance to add four new positions at the Port Commission and adjust staffing at the Airport Commission by substituting 31 positions and adding 128 positions for the fiscal year 2023-2024. It reflects changes in workforce needs for these departments.

This ordinance outlines the salaries and positions funded by the city budget for the fiscal years ending June 30, 2024, and June 30, 2025. It establishes compensation, work schedules, and authorizes appointments for both permanent and temporary city positions.

It aims to assess the effectiveness of these audits and identify any improvements needed to ensure timely reviews and transparency for the public.

The ordinance updates the Language Access Ordinance to ensure that city departments provide language services in multiple languages, including Chinese, Spanish, and Filipino, and clarifies their responsibilities in crisis situations. It also establishes requirements for reporting, budgeting, and public notification regarding these language access services.

Ordinance amending the Administrative Code to amend the Language Access Ordinance to clarify Departments’ responsibilities to provide language access services to members of the public, and to clarify the role of the Office of Civic Engagement and Immigrant Affairs in administering the Language Access Ordinance; to require language access service be provided in Chinese, Spanish, Filipino, and any other language for which the requisite number of persons qualify as a Substantial Number of Limited English Proficient Persons; to lower the threshold amount for the requisite number of persons needed to meet the definition of Substantial Number of Limited English Proficient Persons; to amend the formula for determining when a language becomes eligible for language access services; to require Departments to translate signage; to require Departments to translate digital content provided on digital platforms; to clarify that crisis situations also includes but is not limited to pandemics, refugee relief, and disaster-related activities; to require departments that provide emergency response services in the event of a crisis situation or disaster-related services, involving an immediate threat of serious harm, mass causalities, conditions of natural disaster, or conditions posing extreme peril to the safety of persons and property to provide language access services; to rename the Annual Compliance Plan to Annual Compliance Report; to impose requirements for the Language Access Ordinance Summary Report; to require Departments to inform members of the public of their right to file a complaint, and of a process for providing feedback on the Department’s Language Access Services; to require Office of Civic Engagement and Immigrant Affairs to create a know-your-rights brochure; to require Departments’ posting notice of the availability of Language Access Services and a know-your-rights brochure; to require Departments to budget and plan for delivery of Language Access Services; to require Office of Civic Engagement and Immigrant Affairs to prepare an investigation summary report of each investigation that will include findings and recommendation to address the issues raised, and to create and maintain a website for the posting of investigation summary reports; and to delete the financial disclosure requirement for Immigrant Rights Commission members.

This ordinance creates the Library Laureate Programs, allowing the Library to award stipends to selected individuals who have made significant contributions to culture and leadership. The recipients, chosen through a competitive process, will provide services to the City in recognition of their achievements.

This ordinance allows the Assessment Appeals Board to conduct remote hearings where no members are physically present, as well as hybrid hearings where some members are in-person and others are remote. This change aims to improve accessibility and efficiency in the appeals process.

The ordinance approves an extension of contracts with the U.S. Department of Energy for low-cost power delivery to Treasure Island and Yerba Buena Island, increasing the total contract amount to $41.5 million and extending the term until December 31, 2029. It also includes provisions for the City to indemnify the U.S. against claims and waives certain administrative requirements.

Ordinance approving the fourth amendments to two contracts between the San Francisco Public Utilities Commission (SFPUC) and the United States Department of Energy Western Area Power Administration for delivery of low-cost power and scheduling coordinator services to Treasure Island and Yerba Buena Island to extend the term by five years and three months from October 1, 2024, for a total term of September 1, 2005, through December 31, 2029, and increasing the maximum amount of the agreements to $41,500,000; approving the City indemnifying and holding harmless the United States against claims arising from the City’s activities under the contract; waiving Administrative Code requirements that a City contract contain a statement of guaranteed maximum costs and a statement regarding liability of claimants for submitting false claims; and waiving certain other Administrative Code and Environment Code requirements upon findings made by the SFPUC General Manager.

This ordinance creates a program that offers forgivable loans to help low, moderate, and middle-income first-time homebuyers purchase a home in San Francisco. It also establishes a fund and requires the Human Rights Commission to set up policies for issuing and managing these loans.

Ordinance amending the Administrative Code to establish the Forgivable Loan for First-Time Homebuyers Program and the Forgivable Loan for First-Time Homebuyers Fund to assist low, moderate, and middle-income first-time homebuyers who would otherwise not be able to purchase a primary residence in San Francisco; and to require the Human Rights Commission, in consultation with the Mayor’s Office of Housing and Community Development, to establish policies and procedures to issue and possibly forgive loans from the Fund, and to provide oversight, monitoring, and forgiveness of such loans.

This ordinance requires the Controller’s Whistleblower Program to report to the Board of Supervisors on the outcomes of investigations that confirm misconduct by city department heads and elected officials. It aims to increase transparency and accountability in local government.

This ordinance allows the Department of Elections to use social media monitoring technology as part of its surveillance policy. It aims to ensure that the use of such technology is regulated and transparent.

This ordinance allows tenants to bring a tenant association representative to meetings with their landlord and sets rules for tenant association meetings. It also clarifies the conditions under which tenant associations maintain their status and the requirement for landlords and tenant associations to negotiate in good faith.

This legislation is a hearing to investigate whether Board of Appeals Member Darryl Honda failed to disclose any conflicts of interest in his actions. It requests that Honda provide information during this inquiry.

The ordinance authorizes the City to settle a lawsuit for $90,000 related to a personal injury claim by Debra Crismani that occurred on a City sidewalk. This settlement resolves the legal dispute filed in March 2022.
